Approval of Agenda and Minutes from May 2, 2022

The agenda was amended to add after “Needs and Confirmation” the discussion and vote to invoke AP361. Also, there were corrections to the time schedule. 

Mary D moved, Lisa M seconded to approve both minutes and amended agenda. No objection.

Public Comment on items not on agenda (Senate cannot discuss or take action)

Mary D: The Senate has voted and passed unanimously twice in the last couple years a proposal to include part-time faculty members with re-employment preference in higher level hiring committees, from deans, directors, vice presidents to presidents. She asked if these decisions and the subsequent resolution were being implemented. Or, if the Senate will need to take up the matter again.

Cheryl explained that the Senate decision from five years ago went to DECCA to ask that language be added to the Administrative Procedures for hiring. DECCA did not accept the proposal to include that language at the district level. This year the Senate passed a resolution to request the same language on the college level. That resolution, along with all other resolutions, are on the Senate website. The resolution was shared with the Vice President of Instruction and the President. They are all on board to implement it on the college level. There has not been any administrative hiring since the passage of the resolution.

Needs and Confirmation

There have not been any faculty volunteers for any of the following positions. 

One faculty for the Affordable Housing Task Force (Request from Eric Reed)

Three faculty members for Faculty Coordinator of Equity in Online Education Hiring Committee
This is a full time tenure track faculty position.
The committee will meet in Spring 2022 to create the job announcement. The work on reviewing applications, choosing interviewees, and holding interviews will take place Fall 2022.

Six faculty for Stakeholder Sub-Groups Measure G Bond Projects
Jennifer Manato will come to the Senate to explain the projects.
Positions opened until filled.

One faculty voting member position on Administrative Planning and Budget Team (APBT)
Shagun who has been serving that position was asked to continue in that role. She would like to give others an opportunity to serve and for the committee to get a fresh voice and fresh thoughts.

Vote to continue to invoke AP361 Brown Act

The Senate voted to invoke AB361 that allowed virtual meetings under certain conditions. The Senate will need to vote every 30 days to continue meeting online.

“Given we are in a state of emergency and meeting in person may present a clear present hazard to our health” 

Diana motioned, Mark seconded to invoke AB361 to continue meeting online.

Academic Senate Elections deadline extension

Cheryl asked the executive committee to affirm a decision made by the Senate officers and the nominating committee to extend by one week the deadline to submit statements for the Vice President and the at-large part-time representative positions. This was due to the Work to Contract and the failure to send out a reminder email. Also, there was a discrepancy between the posted May 1 deadline and the May 6 deadline recorded in the April 11 Senate minutes. 

Cheryl moved to make a one-time exception to the bylaws to extend the deadline to May 9, 5 pm for the submission of candidate statements for the two open positions of Vice President and at-large part-time rep. Mark seconded. The decision will need a two-third majority to pass.

Introductions - 

The Senate had some new members, and was adjusting to the HyFlex format. Everyone went into breakout rooms of up to five people to introduce themselves, to get to know each other, and to build community.

People found it fun, refreshing, and it was nice to connect.

Role and membership of Academic Senate

Three weeks ago there was a proposal to change the membership of the affinity members in the Senate from associate members to voting members. There were discussions in the 2nd reading two week ago. That was tabled. The continuation and decision have been scheduled for this meeting.

The Senate meeting followed the Roberts Rules that could be intimidating for new members. The following cheat sheet  cheat sheet #1, cheat sheet #2 and commentary could be helpful.

Cheryl reviewed the Academic Senate’s duties and purview as outlined in 10+1. Some of the items like program development, student preparation and success, college governance structures,  faculty professional development, program review, planning and budget development, require very broad representation. Therefore, efforts have been focused on filling all Senate voting seats as well as representation from equity areas that carry the interests of our most marginalized students.

The Senate Constitution and Bylaws were revised recently, April 2021.

Constitution of the De Anza College Academic Senate
Article III. Definition of regular membership. All faculty, full and part-time, are members of the Academic Senate. There are different levels of membership. 

Article V The officers, their terms of office, removal from offices and vacancies.

Article VI, Executive Committee have voting and non-voting members. Section C Associate Membership.  “Faculty associate members may make or amend motions/resolutions, but shall not have the right to vote at Executive Committee meetings.”

Bylaw Article VI, The Executive Committee listed the areas that have Faculty Senator representation that have voting rights. 

The Associate Membership without voting rights included representatives from the three current affinity groups: Black Faculty, Staff, and Administrators’ Association (BFSA); Asian Pacific American Staff Association (APASA); De Anza Latinx Association (DALA)

The discussion on making affinity group representatives voting members of Academic Senate was continued from the April 25 meeting.

Lilianna, Patty Guitron, Mari, and Felisa read a statement from DALA, in support of the Academic Senate to include Affinity Groups as voting members.

Melinda, President, BFSA: They stood in agreement with DALA to include affinity groups as voting members.

Rosanna Giannini Quinn, interim faculty coordinator for the Women Gender and Sexuality Center, spoke on behalf of the LGBTQ+. They have been meeting as an affinity group and that has been a very welcome place and a safer space for them. She wholeheartedly supported and appreciated those speaking on this topic and the efforts being made to further ensure affinity groups have a voice in shared governance.

Karen Chow read a statement from Nicky Gozandez Yuen, political science, in support of the proposal.

Dawn on behalf of APASA fully support the DALA and BFSA statements There will be a statement forthcoming from APASA.

Melinda motioned to extend discussion 10 minutes; Lisa seconded. No objections.

There was much discussion on how to have a fair and equity process to support, identify/recognize affinity groups; how affinity groups could organize to ensure greater voice and greater inclusion.

Constitution section A.2. lays out a process. It grants for elasticity in membership "as institution changes.

Allowing affinity groups to have voting rights makes a statement. It will continue to evolve with time. Representation for the under-represented groups is long overdue. The Senate is moving in the right direction. Have true representation through where it counts. VOTING!!
